The Joyne product

Use of the Joyne product, including pilots, is governed by a separate written agreement between Joyne and each customer. If that agreement and these terms conflict, the agreement wins. These terms cover only the website.

Using the website

You may browse the website and share links to its pages. You must not:

• use it in a way that breaks the law or anyone’s rights;
• try to gain unauthorized access to it, probe or test its security, or interfere with how it works;
• introduce malware, or send automated requests beyond normal browsing (search engine indexing is fine);
• copy, scrape or frame substantial parts of it, or use its content to build a competing product or to train machine learning models; or
• misrepresent who you are or any connection with Joyne.

Intellectual property

The website and its text, videos, images and software, and the Joyne name and logos, belong to Joyne or its licensors. We give you a limited, revocable right to view the website for your own business purposes, such as evaluating Joyne. No other rights are granted. If you send us feedback or ideas, we may use them without any obligation to you.

Illustrations, not advice

The videos, examples and quantities on this website show how Joyne works. They are not an estimate, a quote, engineering or other professional advice, or an offer to supply goods. In the product, Joyne’s results are prepared for the customer’s own team to check before any quote is released.

Other websites

Links to other websites and services are for convenience. We don’t control them and aren’t responsible for their content or practices.

Privacy

Our privacy policy explains how we handle personal information, and our cookie policy describes the cookies and similar technologies we use.

Disclaimers

We work to keep the website accurate and available, but we provide it “as is” and “as available”. To the extent the law allows, we make no warranties about it, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

Nothing in these terms excludes, restricts or modifies any right, remedy or guarantee that cannot lawfully be excluded, including under the Australian Consumer Law.

Limitation of liability

To the extent the law allows:

• we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, data or goodwill, arising from your use of the website; and
• our total liability for all claims relating to the website is limited to US$100.

Where the Australian Consumer Law applies and our liability for failing to comply with a consumer guarantee can be limited, it is limited to supplying the services again or covering the cost of having them supplied again.

Your responsibility

If you misuse the website or break these terms, you are responsible for the loss this causes us, including reasonable legal costs, to the extent the law allows.

Governing law

These terms are governed by the laws of the State of Delaware, USA, and you and we submit to the non-exclusive jurisdiction of the state and federal courts in Delaware.

If you are a consumer, or the law where you live gives you rights that can’t be excluded or waived by agreement (for example, under the Australian Consumer Law), nothing in these terms takes those rights away, and those laws also apply.

General

If part of these terms is invalid, the rest still applies. If we don’t enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms; we may transfer ours to a successor to our business.

Changes

We may update these terms by posting a new version here with a new date. Changes apply from the date shown.
